Terms and Conditions

These Terms and Conditions govern the access, download and use of the files, documents, software, technical data, programmable ECU files, calibration files and any other material made available through the CM| ECU Development site (hereinafter referred to as the “Materials”).

By downloading the Materials, the user declares to have fully read, understood and accepted these Terms and Conditions.

1. Licence of use

CM| ECU Development grants the user a limited, personal, non-exclusive, revocable and non-transferable licence to use the Materials downloaded from the site.

This licence allows the use of the Materials by the user only and entails no transfer of ownership or intellectual property rights over them.

2. Intellectual property

All the Materials available on the CM| ECU Development site are the exclusive property of CM| ECU Development by Marco Covato or of the respective rights holders and are protected by the regulations in force on copyright and intellectual property.

It is expressly forbidden to:

  • copy, duplicate or reproduce the Materials
  • distribute, share or make the Materials available to third parties
  • sell, resell or commercialise the Materials
  • grant sublicences or transfer the rights of use
  • modify the Materials for commercial purposes without written authorisation

Any unauthorised use may result in legal action and claims for damages.

3. Use of programmable ECU files

The Materials provided by CM| ECU Development may include programmable ECU files, calibration files or technical data intended to modify the operation of the vehicles' electronic control units.

Such Materials are intended exclusively for qualified professionals with adequate technical skills in the automotive sector.

The user assumes full and exclusive responsibility for any use, installation or application of the Materials, including any effects on:

  • vehicle performance
  • vehicle safety
  • reliability of the mechanical and electronic components
  • compliance with the regulations in force

4. Exclusive use for competition / off-road

⚠️ Important notice

The programmable ECU files and technical Materials made available by CM| ECU Development are intended exclusively for use on vehicles employed in sporting competitions, technical tests or off-road use.

Such Materials are not intended for use on vehicles circulating on public roads, except where expressly permitted by the regulations in force in the country of use.

The user is solely responsible for verifying compliance with the applicable laws and regulations.

5. Disclaimer of liability

The Materials are provided “as is”, without any explicit or implicit warranty. CM| ECU Development does not guarantee that the Materials are free from errors, compatible with specific vehicles or systems, or that they produce specific results.

To the maximum extent permitted by law, CM| ECU Development disclaims all liability for any damages arising from the use of the Materials, including but not limited to:

  • damage to the engine or the vehicle
  • malfunctions of electronic control units
  • loss of data
  • economic or commercial loss
  • improper use of the programmable ECU files

6. Indemnity clause

The user agrees to indemnify and hold harmless CM| ECU Development, its owners, collaborators, partners and suppliers from any liability, claim, request for compensation, damage, loss, cost or expense (including any legal costs) arising from:

  • improper use of the Materials
  • installation or application of the programmable ECU files
  • technical modifications made to vehicles
  • violation of the regulations in force
  • damage to people, vehicles or property arising from the use of the Materials

7. Compliance with regulations

The user is solely responsible for compliance with local, national and international regulations regarding the use of the Materials, including any regulations concerning:

  • vehicle emissions
  • type approvals and technical modifications
  • use of vehicles on public roads

8. Acceptance of the terms

Downloading the Materials from the CM| ECU Development site constitutes full and unconditional acceptance of these Terms and Conditions.
